* Parcels with a variance for 'No Public Road frontage' or homes constructed on lot without public road frontage prior to April 28, 1976, meet the following setbacks Front 40 foot; side 15 foot; Rear 25 foot.

** Front and corner side setbacks shall be taken from the ultimate right-of-way.

*** If the house existed prior to May 26, 1988, the front setback may be the same setback as the existing dwelling, but no less than 40 feet.

**** If the house existed prior to June 23, 1993, the front setback may be the same setback as the existing dwelling, but no less than 40 feet.

Additions to Primary Structures

  • Same as the required setback for principal structure in the district (see zoning ordinance for permitted yard encroachments);
  • If the primary structure conforms to the ordinance but no longer meets the required front or corner side setbacks due to an eminent domain take by state or county occurs after the primary structure is constructed then the addition may no closer to the ultimate right-of-way than the existing primary structure, if the primary structure is less than 40 feet from the ultimate right-of-way any addition shall be setback no less than 40 feet.

Accessory Buildings - Less Than 12 Feet Tall

  • Front - Lesser of ½ the depth of lot or 80 feet
  • Side - Not less than ½ of side yard setback for a principal structure in above zoning district
  • Corner Side - Not less than the front yard setback for a principal structure in zoning district
  • Rear - Not less than a 10-foot setback

Accessory Buildings - More Than 12 Feet Tall

  • Front - Lesser of ½ the depth of lot or 80 feet
  • Side - Not less than side yard setback for a principal structure in zoning district
  • Corner Side - Not less than the front yard setback for a principal structure in zoning district
  • Rear - Not less than ½ the rear yard setback for a principal structure in zoning district

General Parcel Division Standards

Any agricultural parcel must be a minimum of 5 acres and must have a minimum 150 feet of lot width established at the front yard setback line. The parcel must have a minimum 250 feet of state maintained public road frontage and the required minimum road frontage width shall be maintained for a depth required to create a 5 acre parcel.

If the parcel is an immediate family transfer of land, the parcel must have a minimum of 1 acre, 15 feet of state maintained public road frontage and 150 feet of lot width established at the front setback line. A member of the immediate family is defined as any person who is a natural or legally defined offspring spouse, sibling, grandchild, grandparent, or parent of the parcel owner.

Parcels may require amended or line modification plats for line shifts or for combining parcels. The parcel creation date is very important on acreage parcels.
