PLEASE REPLACE ALL REFERENCES TO OAKMONT WITH PINE VALLEY.
MORE CLARITY IS NEEDED AS TO WHAT LAND AREA IS WITHIN THE
LIMITS OF THIS TENTATIVE PLAT. WE WANT TO WORK WITH
PLANNING TO DETERMINE HOW TO GRAPHICALLY INCREASE THE
NEEDED CLARIFICATION.
THE CUL-DE-SAC, TWIN FALLS TERRACE, COMING OFF OF TWIN
FALLS LANE, IS FINE. HOWEVER, THE ROAD NAME TWIN FALLS
CROSSING IS A ROAD NAME DUPLICATION. PLEASE FIND A NEW
ROAD NAME FOR TWIN FALLS CROSSING.
SINCE GREAT FALLS DRIVE CIRCLES AROUND ON ITSELF, THE
STANDARD CONVENTION FOR ROAD NAMES DOING THIS WOULD CALL
FOR THE GREAT FALLS DRIVE ROAD NAME TO BE REPLACED WITH
GREAT FALLS CIRCLE. GREAT FALLS WAY, GREAT FALLS LANE, AND
GREAT FALLS TRAIL ALL NEED COMPLETELY NEW, SEPARATE ROAD
NAMES FROM GREAT FALLS BECAUSE THEY ARE NOT CUL-DE-SACS
COMING OFF A ROAD OF THE SAME NAME, BUT ARE THROUGH ROADS.

SAME. THE RECORD APPEARS TO SHOW THAT THE MAGNOLIA GREEN
RPA HYBRID PLAN WAS NOT A PART OF THE VESTING PROCESS
MANAGED BY THE COUNTY ATTORNEY THROUGH THE DIRECTOR OF
PLANNING, BUT INSTEAD WAS AN AGREEMENT BETWEEN MAGNOLIA
GREEN'S ATTORNEY, ED KIDD AND THE DIRECTOR OF
ENVIRONMENTAL ENGINEERING, RICHARD M. MCELFISH. THE
HYBRID PLAN DID NOT PERTAIN TO BLACKMAN CREEK SINCE THAT
WAS ALREADY A SOLID BLUE LINE ON THE U.S.G.S. MAPS, BUT DID
PERTAIN TO SIDE TRIBUTARIES OF BLACKMAN CREEK THAT TRAVERSED
MAGNOLIA GREEN WHICH WERE DESIGNATED AS RPA WITHOUT THE
BENEFIT OF THE NORMAL FIELD WORK WHICH IS A PART OF THE RPA
DETERMINATION PROCESS.
SUBSEQUENT TO THE KIDD-MCELFISH AGREEMENT, THERE WAS AN
AGREEMENT BETWEEN THE COUNTY AND THE ATTORNEY GENERAL'S
OFFICE WHICH LED TO THE POLICY WHOSE EFFECTIVE DATE WAS
SEPTEMBER 23, 2009 ENTITLED, "DESIGNATION OF RESOURCE
PROTECTION AREAS RESULTING FROM THE PERENNIAL FLOW AND
NON TIDAL WETLAND DETERMINATION PROCESS" WHICH APPLIES
TO ALL TENTATIVE SUBDIVISION PLATS AND SITE PLAN APPLICATION
SUBMITTED AFTER SEPTEMBER 23, 2009.
IN ACCORDANCE WITH THIS ENVIRONMENTAL ENGINEERING POLICY,
DCR GUIDANCE WOULD BE REQUIRED TO BE APPLIED TO THE RPA
DETERMINATION FROM BLACKMAN CREEK AND THE TWO
TRIBUTARIES OF BLACKMAN CREEK WHICH WERE DESIGNATED AS
RPAS PER THE HYBRID PLAN. A FIELD DETERMINATION WOULD BE
REQUIRED TO SEE IF ANY OTHER PERENNIALITY WITHIN THE LIMITS
THIS TENTATIVE PLAT WOULD BE FOUND. THIS TENTATIVE PLAT NEE
TO BE REVIEWED BY THE WATER QUALITY SECTION OF THE
ENVIRONMENTAL ENGINEERING DEPARTMENT FOR CONSISTENCY
WITH THIS POLICY. YOU ARE WELCOME TO CONTACT THE COUNTY
ATTORNEY FOR THE PURPOSES OF SEEKING THE CORRECT BALANCE OF
THE "SCALES OF JUSTICE" BETWEEN THE TWO COMPETING
AGREEMENTS.
PLEASE PROVIDE A LETTER FROM THE RECOGNIZED WETLAND
EXPERT REGARDING THE ACCURACY OF THE WETLANDS DELINEATION
PORTRAYED ON THE TENTATIVE PLAT THAT IS THE BASIS FOR THE
RPA-LIMITS ESTABLISHMENT. SUGGESTED WORDING IS, "I HAVE
VIEWED THE TENTATIVE PLAT FOR PINE VALLEY DATED JULY 12,
2013 BY TIMMONS GROUP AND FIND THAT IT PORTRAYS AN
ACCURATE REPRESENTATION OF MY FIELD DELINEATION
OF THE WETLANDS LOCATED ADJACENT TO BLACKMAN CREEK AND
OTHER PERENNIAL TRIBUTARIES.
WITH RESPECT TO CBPA, THE POST DEVELOPMENT POLLUTANT
LOADING PROCESS SHOULD GO AS FOLLOWS:
1. THE OPEN SPACE ACREAGE OF 64.44 ACRES AND THE LOT
ACREAGE OF 43.00 ACRES WOULD BE ADDED TOGETHER FOR
107.44 ACRES. THE 107.44 ACRES WOULD THEN BE DIVIDED
BY THE 241 LOTS RENDERING AN AVERAGE LOT SIZE OF .45
ACRES. THE DEFAULT LEVEL OF IMPERVIOUSNESS FOR THAT
AVERAGE LOT SIZE IS 21.5%, WHICH RENDERS A PHOSPHOROUS
LOAD OF .55 POUNDS PER ACRE PER YEAR. FURTHER DISCUSSION
IS NEEDED TO DISCUSS HOW THE IMPERVIOUSNESS FROM THE
ARTERIALS AND THE IMPERVIOUSNESS FROM SIDEWALKS WOULD
BE ACCOUNTED FOR IN THE PROCESS OF DETERMINING THE POST
DEVELOPMENT POLLUTANT LOADING. WE SHOULD MEET TO
DISCUSS.
THE PRELIMINARY CBPA PLAN SHOULD BE AT THE SAME 1" =
100' SCALE AS THE TENTATIVE PLAT. IT CAN BE A SEPARATE
SUBMITTAL FROM THE TENTATIVE PLAT.
FOR THE 16 BMPS AND THEIR ASSOCIATED WATERSHEDS, AN
IMPERVIOUSNESS PERCENTAGE HAS BEEN PROVIDED. HOWEVER,
NO BASIS FOR THE ASSIGNED PERCENTAGE HAS BEEN PROVIDED.
PLEASE ADDRESS. AS A FOR INSTANCE, AN ANALYSIS OF THE LEVEL
IMPERVIOUSNESS IN THE WATERSHED OF BMP 13 WOULD APPEAR
TO RESULT IN AN IMPERVIOUSNESS LEVEL OF SOMETHING
CONSIDERABLY LESS THAN 35%. PLEASE ADDRESS.
IS BMP #12 THE SAME FACILITY AS BMP #4 IN THE WOOLRIDGE
ROAD EXTENSION PHASE I CONSTRUCTION PLANS?
A CONCEPT DRAWING OR OTHER APPROPRIATE GRAPHIC SHOWING
THE ZERO LOT LINE HOUSING CONCEPT TO BE USED ALONG WITH A
TYPICAL DESIGN APPROACH FOR HANDLING THE STORMWATER RUNOFF
IS NEEDED. THE TYPICAL COMPLAINT IS "WHY ARE YOU ALLOWING
MY NEIGHBOR'S HOUSE TO DRAIN ON ONTO MY PROPERTY?"
PERHAPS THERE IS AN APPROACH UTILIZING EASEMENTS AND
UNDERGROUND PIPING OF WATER FROM THE DOWNSPOUTS THAT
WOULD PROVIDE A SOLUTION. YOUR CAREFUL CONSIDERATION OF
THIS MATTER WOULD BE APPRECIATED FOLLOWED BY A MEETING TO
DISCUSS.
PRIOR TO APPROVAL OF THE PINE VALLEY @ MAGNOLIA GREEN
TENTATIVE, THE DEVELOPER WILL SUBMIT A LETTER OF
ACKNOWLEDGEMENT OF THE CONDITION REGARDING MASONRY
EMBELLISHMENTS WITHIN THE VDOT CLEAR ZONE. THIS
ACKNOWLEDGEMENT IS THE RESPONSIBILITY OF THE DEVELOPER
AND NOT HIS REPRESENTATIVE AS HE IS ULTIMATELY RESPONSIBLE
FOR REMOVAL OF HEADWALLS IN ALL NEW SUBDIVISIONS SHOULD IT
BECOME NECESSARY. A DRAFT OF THAT LETTER IS ENCLOSED FOR
YOUR CONVENIENCE.
TENTATIVE CONDITIONS COULD INCLUDE BUT NOT BE LIMITED TO THE
FOLLOWING:
1. THE BMP'S INITIAL, PREDOMINANT WATER-QUALITY FUNCTION
SHALL BE SEDIMENT CONTROL; THE IMPLEMENTATION OF WHICH
SHALL BE COORDINATED WITH THE FIRST PORTION OF THE PROJECT
THAT DRAINS IN ITS DIRECTION.
2. THE PEDESTRIAN-ACCESS FACILITIES DESIGN AS SHOWN ON THE
TENTATIVE SHALL BE INCLUDED IN THE ROAD AND DRAINAGE PLANS
THAT MUST BE APPROVED BY BOTH VDOT AND THE
ENVIRONMENTAL ENGINEERING DEPARTMENT. ROAD RIGHT-OF-
WAY SHALL BE WIDE ENOUGH TO ENCOMPASS THE PEDESTRIAN-
ACCESS FACILITIES IF THE SIDEWALKS MEET STATE CRITERIA.
3. UNLESS OTHERWISE APPROVED BY THE ENVIRONMENTAL
ENGINEERING DEPARTMENT, THE SPILLWAY STRUCTURE FOR THE WET
POND(S) SHALL BE A CONCRETE WEIR.
4. ROOF GUTTERS AND DOWNSPOUTS SHALL BE INSTALLED ON THE
DWELLINGS. ALL ROOF DRAINAGE LEADERS WILL BE TIED DIRECTLY
INTO MINIMUM 12" ONSITE STORM SEWERS OR OTHER STABLE
CONVEYANCE SYSTEMS DEEMED APPROPRIATE BY THE
ENVIRONMENTAL ENGINEERING DEPARTMENT.
5. STORM DRAINAGE FACILITIES THROUGH THE GOLF COURSE
CONNECTING THE DEVELOPMENT TO POINTS OF ADEQUATE NATURAL
WATERCOURSE SHALL MEET ALL EXISTING, MINIMUM CRITERIA AND
SHALL BE ENCLOSED IN DRAINAGE EASEMENTS THAT ESTABLISH
PRIVATE OWNERSHIP AND MAINTENANCE OF THOSE FACILITIES BY
THE GOLF-COURSE OPERATORS. USE OF THE STANDARD COUNTY
DRAINAGE EASEMENT (PRIVATE) WILL ACCOMPLISH THIS.
6. THE DESIGN AND CONSTRUCTION OF THE SWM/BMPS THAT
WILL BE COUNTY MAINTAINED FACILITIES SHALL BE SUBJECT TO
DOCUMENTED GEOTECHNICAL APPROVAL. THE SERVICES THAT
MUST BE PROVIDED BY THE GEOTECHNICAL ENGINEER SHALL
INCLUDE FULL-TIME GEOTECHNICAL INSPECTION PAID FOR BY THE
DEVELOPER. THAT FULL-TIME INSPECTION SHALL INCLUDE BUT NOT
BE LIMITED TO THE FOLLOWING:
A. PARTICIPATION/INPUT INTO THE DESIGN PROCESS AS NECESSARY
TO FACILITATE THE APPROVAL PROCESS OF THE INDEPENDENT
GEOTECHNICAL CONSULTANT. OBSERVATION, TESTING AND
DOCUMENTATION OF:
I. SUITABLE SUB-GRADES TO RECEIVE COMPACTED STRUCTURAL
FILL FOR EARTH DAM CONSTRUCTION.
II. THE CUT-OFF TRENCH, SPILLWAY PIPE, DRAINAGE BLANKET,
RISER STRUCTURE, AND CONCRETE CHUTE SPILLWAY SUB-GRADES AS
APPLICABLE TO EVALUATE WHETHER SUITABLE SOIL IS PRESENT AT
BEARING GRADE TO VERIFY PROPER INSTALLATION.
III. REINFORCING STEEL, IF REQUIRED, TO EVALUATE ITS
CONFORMANCE WITH THE PROJECT PLANS AND SPECIFICATIONS.
7. THE NAME OF THE GEOTECHNICAL PROFESSIONAL WHO WILL
PROVIDE THE GEOTECHNICAL APPROVAL ON THE DAM WILL BE
FURNISHED PRIOR TO THE ISSUANCE OF THE LAND DISTURBANCE
PERMIT.
8. THE SUB-DIVIDER SHALL POST SIGNS DEMARKING THE LIMITS
OF THE RPA AREA SO BUILDERS AND HOMEOWNERS MAY BE
INFORMED AS TO THE LIMITATIONS IMPOSED ON THESE AREAS.
SPECIFIC PLANS FOR THE EXACT NUMBER AND PLACEMENT OF THE
SIGNS SHALL BE APPROVED BY THE ENVIRONMENTAL ENGINEERING
DEPARTMENT.
9. LANGUAGE SHALL BE INCORPORATED INTO THE HOMEOWNERS'
ASSOCIATION COVENANTS ADVISING HOMEOWNERS WITH AN RPA
ON OR ADJACENT TO THEIR PROPERTY STATING THAT RPAS ARE TO
REMAIN IN THEIR NATURALLY VEGETATED STATE AND THAT THE
COUNTY'S CHESAPEAKE BAY PRESERVATION ORDINANCE
REQUIREMENTS RELATING TO RPAS READS AS FOLLOWS: "A
VEGETATED CONSERVATION AREA THAT RETARDS RUNOFF, PREVENTS
EROSION, AND FILTERS NON-POINT SOURCE POLLUTION FROM RUNOFF
SHALL BE RETAINED IF PRESENT AND SHALL BE ESTABLISHED WHERE
IT DOES NOT EXIST." SECTION 19-232 OF CHESTERFIELD COUNTY
CODE STATES, "IF A HOMEOWNER WISHES TO MODIFY THE RPA,
A PLAN MUST BE SUBMITTED TO THE ENVIRONMENTAL
ENGINEERING DEPARTMENT FOR THEIR APPROVAL PRIOR TO THE
COMMENCEMENT OF ANY LAND CLEARING ACTIVITY."
10. PRIOR TO RECORDATION, A COPY OF THE COVENANTS AND
ARTICLES OF INCORPORATION OF THE HOMEOWNERS' ASSOCIATION
SHALL BE PROVIDED TO THE ENVIRONMENTAL ENGINEERING
DEPARTMENT FOR APPROVAL. IN ADDITION TO LANGUAGE
PERTAINING TO THE RPA, THE ENVIRONMENTAL ENGINEERING
DEPARTMENT WILL DETERMINE WHETHER THE SUBDIVISION HAS
BEEN PROVIDED WITH THE INFORMATION TO DEVELOP AND
IMPLEMENT A FERTILIZATION/LAWN CARE PROGRAM TO MINIMIZE
PHOSPHOROUS RUNOFF FROM MAGNOLIA GREEN. THE
REQUIREMENTS OF THE PROGRAM SHALL BECOME A PART OF THE
COVENANTS FOR THE PROJECT AFFECTING ALL PROPERTIES WITHIN TH
DEVELOPMENT. PER ZONING CONDITION E.11 OF CASE
89SN0343, THE REQUIREMENTS OF THE PROGRAM SHALL BECOME
PART OF THE COVENANTS FOR THE PROJECT AFFECTING ALL
PROPERTIES WITHIN THE DEVELOPMENT.
11. SPECIAL UPPER SWIFT CREEK WATERSHED END TREATMENT
AS DIRECTED BY THE ENVIRONMENTAL ENGINEERING DEPARTMENT
WILL BE PLACED IN THE VICINITY OF THE TERMINUS OF MANMADE
STORM DRAINAGE OUTFALLS.
12. THE ENVIRONMENTAL ENGINEERING DEPARTMENT MAY
IMPOSE A MORE RIGOROUS EROSION AND SEDIMENT CONTROL
PROGRAM THAN THAT WHICH IS PROVIDED BY MINIMUM
STANDARDS FOUND IN THE VIRGINIA EROSION AND SEDIMENT
CONTROL HANDBOOK. THIS WOULD INCLUDE THE UTILIZATION OF
SUPER SILT FENCE AND PAM.
13. AT A TIME DIRECTED BY THE ENVIRONMENTAL ENGINEERING
DEPARTMENT, AND IN A MANNER MUTUALLY AGREED UPON BY THE
DEVELOPER, THE ISSUES CONCERNING THE DOWNSTREAM POND
OWNED BY LEIGH W. & NOEL F. HAGUE, WILL BE RESOLVED.
14. FOR THOSE STREAMS WHICH POSSESS BOTH A NON-RPA
RIPARIAN CORRIDOR MANAGEMENT AREA AND AN RPA, THIS
REDUNDANCY SHALL BE ELIMINATED IN FAVOR OF THE RPA. THE
RPA LIMITS ON THE RECORD PLAT SHALL BE ESTABLISHED BASED
ON THE GREATEST EXTENT OF ENCUMBRANCE BETWEEN THE RPA
AND THE RIPARIAN CORRIDOR MANAGEMENT AREA.

TENTATIVE CONDITIONS:
1. THE BMP'S INITIAL, PREDOMINANT WATER-QUALITY FUNCTION
SHALL BE SEDIMENT CONTROL; THE IMPLEMENTATION OF WHICH
SHALL BE COORDINATED WITH THE FIRST PORTION OF THE PROJECT
THAT DRAINS IN ITS DIRECTION.
2. THE PEDESTRIAN-ACCESS FACILITIES DESIGN AS SHOWN ON THE
TENTATIVE SHALL BE INCLUDED IN THE ROAD AND DRAINAGE PLANS
THAT MUST BE APPROVED BY BOTH VDOT AND THE
ENVIRONMENTAL ENGINEERING DEPARTMENT. ROAD RIGHT-OF-
WAY SHALL BE WIDE ENOUGH TO ENCOMPASS THE PEDESTRIAN-
ACCESS FACILITIES IF THE SIDEWALKS MEET STATE CRITERIA.
3. UNLESS OTHERWISE APPROVED BY THE ENVIRONMENTAL
ENGINEERING DEPARTMENT, THE SPILLWAY STRUCTURE FOR THE WET
POND(S) SHALL BE A CONCRETE WEIR.
4. ROOF GUTTERS AND DOWNSPOUTS SHALL BE INSTALLED ON THE
DWELLINGS. ALL ROOF DRAINAGE LEADERS WILL BE TIED DIRECTLY
INTO MINIMUM 12" ONSITE STORM SEWERS OR OTHER STABLE
CONVEYANCE SYSTEMS DEEMED APPROPRIATE BY THE
ENVIRONMENTAL ENGINEERING DEPARTMENT.
5. STORM DRAINAGE FACILITIES THROUGH THE GOLF COURSE
CONNECTING THE DEVELOPMENT TO POINTS OF ADEQUATE NATURAL
WATERCOURSE SHALL MEET ALL EXISTING, MINIMUM CRITERIA AND
SHALL BE ENCLOSED IN DRAINAGE EASEMENTS THAT ESTABLISH
PRIVATE OWNERSHIP AND MAINTENANCE OF THOSE FACILITIES BY
THE GOLF-COURSE OPERATORS. USE OF THE STANDARD COUNTY
DRAINAGE EASEMENT (PRIVATE) WILL ACCOMPLISH THIS.
6. THE DESIGN AND CONSTRUCTION OF THE SWM/BMPS THAT
WILL BE COUNTY MAINTAINED FACILITIES SHALL BE SUBJECT TO
DOCUMENTED GEOTECHNICAL APPROVAL. THE SERVICES THAT
MUST BE PROVIDED BY THE GEOTECHNICAL ENGINEER SHALL
INCLUDE FULL-TIME GEOTECHNICAL INSPECTION PAID FOR BY THE
DEVELOPER. THAT FULL-TIME INSPECTION SHALL INCLUDE BUT NOT
BE LIMITED TO THE FOLLOWING:
A. PARTICIPATION/INPUT INTO THE DESIGN PROCESS AS NECESSARY
TO FACILITATE THE APPROVAL PROCESS OF THE INDEPENDENT
GEOTECHNICAL CONSULTANT. OBSERVATION, TESTING AND
DOCUMENTATION OF:
I. SUITABLE SUB-GRADES TO RECEIVE COMPACTED STRUCTURAL
FILL FOR EARTH DAM CONSTRUCTION.
II. THE CUT-OFF TRENCH, SPILLWAY PIPE, DRAINAGE BLANKET,
RISER STRUCTURE, AND CONCRETE CHUTE SPILLWAY SUB-GRADES AS
APPLICABLE TO EVALUATE WHETHER SUITABLE SOIL IS PRESENT AT
BEARING GRADE TO VERIFY PROPER INSTALLATION.
III. REINFORCING STEEL, IF REQUIRED, TO EVALUATE ITS
CONFORMANCE WITH THE PROJECT PLANS AND SPECIFICATIONS.
7. THE NAME OF THE GEOTECHNICAL PROFESSIONAL WHO WILL
PROVIDE THE GEOTECHNICAL APPROVAL ON THE DAM WILL BE
FURNISHED PRIOR TO THE ISSUANCE OF THE LAND DISTURBANCE
PERMIT.
8. THE SUB-DIVIDER SHALL POST SIGNS DEMARKING THE LIMITS
OF THE RPA AREA SO BUILDERS AND HOMEOWNERS MAY BE
INFORMED AS TO THE LIMITATIONS IMPOSED ON THESE AREAS.
SPECIFIC PLANS FOR THE EXACT NUMBER AND PLACEMENT OF THE
SIGNS SHALL BE APPROVED BY THE ENVIRONMENTAL ENGINEERING
DEPARTMENT.
9. LANGUAGE SHALL BE INCORPORATED INTO THE HOMEOWNERS'
ASSOCIATION COVENANTS ADVISING HOMEOWNERS WITH AN RPA
ON OR ADJACENT TO THEIR PROPERTY STATING THAT RPAS ARE TO
REMAIN IN THEIR NATURALLY VEGETATED STATE AND THAT THE
COUNTY'S CHESAPEAKE BAY PRESERVATION ORDINANCE
REQUIREMENTS RELATING TO RPAS READS AS FOLLOWS: "A
VEGETATED CONSERVATION AREA THAT RETARDS RUNOFF, PREVENTS
EROSION, AND FILTERS NON-POINT SOURCE POLLUTION FROM RUNOFF
SHALL BE RETAINED IF PRESENT AND SHALL BE ESTABLISHED WHERE
IT DOES NOT EXIST." SECTION 19-232 OF CHESTERFIELD COUNTY
CODE STATES, "IF A HOMEOWNER WISHES TO MODIFY THE RPA,
A PLAN MUST BE SUBMITTED TO THE ENVIRONMENTAL
ENGINEERING DEPARTMENT FOR THEIR APPROVAL PRIOR TO THE
COMMENCEMENT OF ANY LAND CLEARING ACTIVITY."
10. PRIOR TO RECORDATION, A COPY OF THE COVENANTS AND
ARTICLES OF INCORPORATION OF THE HOMEOWNERS' ASSOCIATION
SHALL BE PROVIDED TO THE ENVIRONMENTAL ENGINEERING
DEPARTMENT FOR APPROVAL. IN ADDITION TO LANGUAGE

PROGRAM THAN THAT WHICH IS PROVIDED BY MINIMUM
STANDARDS FOUND IN THE VIRGINIA EROSION AND SEDIMENT
CONTROL HANDBOOK. THIS WOULD INCLUDE THE UTILIZATION OF
SUPER SILT FENCE AND PAM.
13. AT A TIME DIRECTED BY THE ENVIRONMENTAL ENGINEERING
DEPARTMENT, AND IN A MANNER MUTUALLY AGREED UPON BY THE
DEVELOPER, THE ISSUES CONCERNING THE DOWNSTREAM POND
OWNED BY LEIGH W. & NOEL F. HAGUE, WILL BE RESOLVED.
14. FOR THOSE STREAMS WHICH POSSESS BOTH A NON-RPA

TENTATIVE CONDITIONS INCLUDE THE FOLLOWING:
1. THE BMP'S INITIAL, PREDOMINANT WATER-QUALITY FUNCTION
SHALL BE SEDIMENT CONTROL; THE IMPLEMENTATION OF WHICH SHALL
BE COORDINATED WITH THE FIRST PORTION OF THE PROJECT THAT
DRAINS IN ITS DIRECTION.
2. THE PEDESTRIAN-ACCESS FACILITIES DESIGN AS SHOWN ON THE
TENTATIVE SHALL BE INCLUDED IN THE ROAD AND DRAINAGE PLANS
THAT MUST BE APPROVED BY BOTH VDOT AND THE ENVIRONMENTAL
ENGINEERING DEPARTMENT. ROAD RIGHT-OF-WAY SHALL BE WIDE
ENOUGH TO ENCOMPASS THE PEDESTRIAN-ACCESS FACILITIES IF THE
SIDEWALKS MEET STATE CRITERIA.
3. UNLESS OTHERWISE APPROVED BY THE ENVIRONMENTAL
ENGINEERING DEPARTMENT, THE SPILLWAY STRUCTURE FOR THE WET
POND(S) SHALL BE A CONCRETE WEIR.
4. ROOF GUTTERS AND DOWNSPOUTS SHALL BE INSTALLED ON THE
DWELLINGS. ALL ROOF DRAINAGE LEADERS WILL BE TIED DIRECTLY
INTO MINIMUM 12" ONSITE STORM SEWERS OR OTHER STABLE
CONVEYANCE SYSTEMS DEEMED APPROPRIATE BY THE ENVIRONMENTAL
ENGINEERING DEPARTMENT.
5. STORM DRAINAGE FACILITIES THROUGH THE GOLF COURSE
CONNECTING THE DEVELOPMENT TO POINTS OF ADEQUATE NATURAL
WATERCOURSE SHALL MEET ALL EXISTING, MINIMUM CRITERIA AND
SHALL BE ENCLOSED IN DRAINAGE EASEMENTS THAT ESTABLISH
PRIVATE OWNERSHIP AND MAINTENANCE OF THOSE FACILITIES BY THE
GOLF-COURSE OPERATORS. USE OF THE STANDARD COUNTY DRAINAGE
EASEMENT (PRIVATE) WILL ACCOMPLISH THIS.
6. THE DESIGN AND CONSTRUCTION OF THE SWM/BMPS THAT WILL BE
COUNTY MAINTAINED FACILITIES SHALL BE SUBJECT TO DOCUMENTED
GEOTECHNICAL APPROVAL. THE SERVICES THAT MUST BE PROVIDED
BY THE GEOTECHNICAL ENGINEER SHALL INCLUDE FULL-TIME
GEOTECHNICAL INSPECTION PAID FOR BY THE DEVELOPER. THAT
FULL-TIME INSPECTION SHALL INCLUDE, BUT NOT BE LIMITED TO,
THE FOLLOWING:
A. PARTICIPATION/INPUT INTO THE DESIGN PROCESS AS NECESSARY
TO FACILITATE THE APPROVAL PROCESS OF THE INDEPENDENT
GEOTECHNICAL CONSULTANT. OBSERVATION, TESTING AND
DOCUMENTATION OF:
I. SUITABLE SUB-GRADES TO RECEIVE COMPACTED STRUCTURAL FILL
FOR EARTH DAM CONSTRUCTION.
II. THE CUT-OFF TRENCH, SPILLWAY PIPE, DRAINAGE BLANKET,
RISER STRUCTURE, AND CONCRETE CHUTE SPILLWAY SUB-GRADES AS
APPLICABLE TO EVALUATE WHETHER SUITABLE SOIL IS PRESENT AT
BEARING GRADE TO VERIFY PROPER INSTALLATION.
III. REINFORCING STEEL, IF REQUIRED, TO EVALUATE ITS
CONFORMANCE WITH THE PROJECT PLANS AND SPECIFICATIONS.
7. THE NAME OF THE GEOTECHNICAL PROFESSIONAL WHO WILL
PROVIDE THE GEOTECHNICAL APPROVAL ON THE DAM WILL BE
FURNISHED PRIOR TO THE ISSUANCE OF THE LAND DISTURBANCE
PERMIT.
8. THE SUB-DIVIDER SHALL POST SIGNS DEMARKING THE LIMITS OF
THE RPA AREA SO BUILDERS AND HOMEOWNERS MAY BE INFORMED AS
TO THE LIMITATIONS IMPOSED ON THESE AREAS. SPECIFIC PLANS
FOR THE EXACT NUMBER AND PLACEMENT OF THE SIGNS SHALL BE
APPROVED BY THE ENVIRONMENTAL ENGINEERING DEPARTMENT.
9. LANGUAGE SHALL BE INCORPORATED INTO THE HOMEOWNERS'
ASSOCIATION COVENANTS ADVISING HOMEOWNERS WITH AN RPA ON OR
ADJACENT TO THEIR PROPERTY STATING THAT RPAS ARE TO REMAIN
IN THEIR NATURALLY VEGETATED STATE AND THAT THE COUNTY'S
CHESAPEAKE BAY PRESERVATION ORDINANCE REQUIREMENTS RELATING
TO RPAS READS AS FOLLOWS: "A VEGETATED CONSERVATION AREA
THAT RETARDS RUNOFF, PREVENTS EROSION, AND FILTERS NON-POINT
SOURCE POLLUTION FROM RUNOFF SHALL BE RETAINED IF PRESENT
AND SHALL BE ESTABLISHED WHERE IT DOES NOT EXIST." SECTION
19-232 OF CHESTERFIELD COUNTY CODE STATES, "IF A HOMEOWNER
WISHES TO MODIFY THE RPA, A PLAN MUST BE SUBMITTED TO THE
ENVIRONMENTAL ENGINEERING DEPARTMENT FOR THEIR APPROVAL
PRIOR TO THE COMMENCEMENT OF ANY LAND CLEARING ACTIVITY."
10. PRIOR TO RECORDATION, A COPY OF THE COVENANTS AND
ARTICLES OF INCORPORATION OF THE HOMEOWNERS' ASSOCIATION
SHALL BE PROVIDED TO THE ENVIRONMENTAL ENGINEERING
DEPARTMENT FOR APPROVAL. IN ADDITION TO LANGUAGE PERTAINING
TO THE RPA, THE ENVIRONMENTAL ENGINEERING DEPARTMENT WILL
DETERMINE WHETHER THE SUBDIVISION HAS BEEN PROVIDED WITH THE
INFORMATION TO DEVELOP AND IMPLEMENT A FERTILIZATION/LAWN
CARE PROGRAM TO MINIMIZE PHOSPHOROUS RUNOFF FROM MAGNOLIA
GREEN. THE REQUIREMENTS OF THE PROGRAM SHALL BECOME A PART
OF THE COVENANTS FOR THE PROJECT AFFECTING ALL PROPERTIES
WITHIN THE DEVELOPMENT. PER ZONING CONDITION E.11 OF CASE
89SN0343, THE REQUIREMENTS OF THE PROGRAM SHALL BECOME PART
OF THE COVENANTS FOR THE PROJECT AFFECTING ALL PROPERTIES
WITHIN THE DEVELOPMENT.
11. SPECIAL UPPER SWIFT CREEK WATERSHED END TREATMENT AS
DIRECTED BY THE ENVIRONMENTAL ENGINEERING DEPARTMENT WILL BE
PLACED IN THE VICINITY OF THE TERMINUS OF MANMADE STORM
DRAINAGE OUTFALLS.
12. THE ENVIRONMENTAL ENGINEERING DEPARTMENT MAY IMPOSE A
MORE RIGOROUS EROSION AND SEDIMENT CONTROL PROGRAM THAN THAT
WHICH IS PROVIDED BY MINIMUM STANDARDS FOUND IN THE VIRGINIA
EROSION AND SEDIMENT CONTROL HANDBOOK. THIS WOULD INCLUDE
THE UTILIZATION OF SUPER SILT FENCE AND PAM.
13. AT A TIME DIRECTED BY THE ENVIRONMENTAL ENGINEERING
DEPARTMENT, AND IN A MANNER MUTUALLY AGREED UPON BY THE
DEVELOPER, THE ISSUES CONCERNING THE DOWNSTREAM POND OWNED
BY LEIGH W. & NOELLE L. HAGUE WILL BE RESOLVED.
14. FOR THOSE STREAMS WHICH POSSESS BOTH A NON-RPA RIPARIAN
CORRIDOR MANAGEMENT AREA AND AN RPA, THIS REDUNDANCY SHALL
BE ELIMINATED IN FAVOR OF THE RPA. THE RPA LIMITS ON THE
RECORD PLAT SHALL BE ESTABLISHED BASED ON THE GREATEST
EXTENT OF ENCUMBRANCE BETWEEN THE RPA AND THE RIPARIAN
CORRIDOR MANAGEMENT AREA.
15. NOTES 5 AND 6 UNDER THE WETLANDS HEADING SHOWN ON SHEET
C1.0 SHALL BE PLACED ON THE CONSTRUCTION PLANS AND RECORD
PLAT.
16. THE RPA LIMITS AND THE APPROVED ENCROACHMENT AREA
THROUGH BMPS 11, 12, 13, AND 14 SHALL BE SHOWN ON THE
CONSTRUCTION PLANS AND RECORD PLAT.
