PARCEL LINE MODIFICATION APPLICATION. THE PROPERTY IS
CURRENTLY ZONED R-12. THE UNDERLYING ZONING CASE,
05SN0295, HAS SEVERAL CONDITIONS OF ZONING THAT ARE
APPLICABLE AT TIME OF THE INITIAL SUBDIVISION RECORDATION.
THESE ITEMS INCLUDE 1) RIGHT-OF-WAY DEDICATION ALONG
SALEM CHURCH ROAD & KINGSLAND ROAD 2) RECORDATION OF
RESTRICTIVE COVENANTS AND 3) RECORDATION OF DEED
RESTRICTIONS (CONDITIONS 7, 12 AND 16). PRIOR TO THE
RECORDATION OF THE PARCEL LINE MODIFICATION, THESE ITEMS
WOULD NEED TO BE ADDRESSED ACCORDINGLY.
STAFF ALSO HAS CONCERN ABOUT THE ULTIMATE CREATION OF THE
BUFFER AND OPEN SPACE THAT IS SHOWN ON THE APPROVED
TENTATIVE PLAT FOR THE SUBJECT PROPERTY. THE CORRECT
PROCESS TO RECORD THE FIRST LOT IN THE SUBDIVISION IS TO
GENERATE A ONE-LOT SUBDIVISION PLAT AND PHASED
CONSTRUCTION PLAN OF REEDY SPRINGS, SECTION A. PLEASE
NOTE THAT THE FIRST LOT WILL REQUIRE A MINIMUM OF 50' OF
STATE MAINTAINED ROAD FRONTAGE.
THE POSSIBLE SALE OF THIS PROPOSED PARCEL (PARCEL B) ALSO
POSES AN UNCERTAINTY IN ENSURING THAT THIS PROPERTY IS
INCLUDED IN THE FIRST SECTION OF THE SUBDIVISION. IF THE
PROPERTY IS CONVEYED TO A THIRD PARTY OUTSIDE OF THE
DEVELOPER'S CONTROL, THE DEVELOPER COULD LOSE THE ABILITY
TO INCLUDE THIS PROPERTY WITHIN THE BOUNDARIES OF REEDY
SPRINGS, SECTION A WHEN IT IS READY TO RECORD.
CONSEQUENTLY, IT MAY PROVE DIFFICULT TO INCORPORATE THIS
PROPERTY THROUGH A LOT SUBDIVISION PROCESS AND HAVE
"PARCEL B" MEET ALL OF THE UNDERLYING ZONING CONDITIONS.
