4. THE AREAS OF STORMWATER RUNOFF CONCENTRATION AS DISCUSSED
IN THE ENVIRONMENTAL ENGINEERING DEPARTMENT TENTATIVE REPORT
DATED SEPTEMBER 29, 2005 WILL BE FIELD LOCATED AND SHOWN ON
THE PLANS. THE CONSTRUCTION PLANS SHALL DESIGNATE THE
AFFECTED LOTS WITH AN NBP, AND AN ENGINEERED STORM SEWER,
FILLING, GRADING, AND DRAINAGE PLAN SHALL BE INCLUDED IN THE
CONSTRUCTION PLANS.
5. THE SUBDIVIDER SHALL POST SIGNS DEMARKING THE LIMITS OF
THE RPA AREA SO BUILDERS AND HOMEOWNERS MAY BE INFORMED AS
TO THE LIMITATIONS IMPOSED ON THESE AREAS. SPECIFIC PLANS
FOR THE EXACT NUMBER AND PLACEMENT OF THE SIGNS SHALL BE
APPROVED BY THE ENVIRONMENTAL ENGINEERING DEPARTMENT.
6. SPECIAL UPPER SWIFT CREEK WATERSHED END TREATMENT AS
DIRECTED BY THE ENVIRONMENTAL ENGINEERING DEPARTMENT WILL BE
PLACED IN THE VICINITY OF THE TERMINUS OF MANMADE STORM
DRAINAGE OUTFALLS.
7. THE ENVIRONMENTAL ENGINEERING DEPARTMENT MAY IMPOSE A
REASONABLE, MORE RIGOROUS ON SITE EROSION AND SEDIMENT
CONTROL PROGRAM THAN THAT WHICH IS PROVIDED BY MINIMUM
STANDARDS FOUND IN THE VIRGINIA EROSION AND SEDIMENT CONTROL
HANDBOOK.
8. BASED ON THE FINDINGS OF A QUALIFIED GEOTECHNICAL
PROFESSIONAL, THE CONSTRUCTION PLANS SHALL SHOW THE LOCATION
OF ALL AREAS OF FORMER MINING ACTIVITY. IF THE LAND AREA
COVERED BY THE CONSTRUCTION PLANS CONTAINS NO FORMER MINING
ACTIVITY, A STATEMENT TO THAT EFFECT WILL BE INCLUDED ON THE
CONSTRUCTION PLANS. IF THE LAND AREA COVERED BY THE
CONSTRUCTION PLANS DOES HAVE MINING ACTIVITY, A STATEMENT
WILL BE INCLUDED WHICH INDICATES THAT THE FORMER MINING
ACTIVITY AS SHOWN ON THE CONSTRUCTION PLANS IS THE FULL
EXTENT OF MINING ACTIVITY WITHIN THE AREA COVERED BY THE
CONSTRUCTION PLANS. THE QUALIFIED PROFESSIONAL WILL ALSO
INDICATE THOSE LOTS WHERE GEOTECHNICAL BORINGS MUST BE
PERFORMED IN ORDER TO INSURE NO HOUSE IS BUILT OVER AREAS
AFFECTED BY FORMER MINING ACTIVITY. IF APPLICABLE,
RECOMMENDED SETBACK DISTANCES FROM AREAS OF FORMER MINING
ACTIVITY SHALL BE SPECIFIED.
9. PRIOR TO RECORDATION THE ENVIRONMENTAL ENGINEERING
DEPARTMENT MUST HAVE RECEIVED DOCUMENTATION FROM THE
GEOTECHNICAL EXPERT THAT ALL AREAS OF FORMER MINING ACTIVITY
AS SHOWN ON THE APPROVED CONSTRUCTION PLAN HAVE BEEN
RECLAIMED IN A MANNER CONSISTENT WITH EITHER DEPARTMENT OF
MINES, MINERALS AND ENERGY RECLAMATION CRITERIA OR CRITERIA
RECOMMENDED BY THE GEOTECHNICAL ENGINEER AS BEING
APPROPRIATE AND IN COMPLIANCE WITH GENERALLY ACCEPTED
GEOTECHNICAL ENGINEERING PRACTICE FOR SUCH SITUATIONS AS MAY
BE ENCOUNTERED. ALL AREAS OF FORMER MINING ACTIVITY SHALL
BE PORTRAYED ON THE RECORD PLAT.
10. IF APPLICABLE, AN OVERALL FILLING, GRADING AND DRAINAGE
PLAN SHALL BE PROVIDED IN THE CONSTRUCTION PLANS TO ASSURE
THAT THE LOTS WHICH ARE WITHIN THE FORMER RAILROAD CORRIDOR
HAVE GROUND CONFIGURATIONS AND STORM DRAINAGE COORDINATION
WITH THE MAJORITY OF THE PROJECT WHICH IS OUTSIDE OF THE
FORMER RAILROAD CORRIDOR. AFFECTED LOTS WILL BE DESIGNATED
WITH AN NBP.
11. INTERIM COMPLIANCE WITH PROFFERED CONDITION NUMBER 17 OF
REZONING CASE 02SN0209 WILL BE ACHIEVED WHEN THE LAND AREA
WITHIN THE HARPERS MILL APPROVED TENTATIVE PLAT WHICH IS
ENCUMBERED BY A TEMPORARY REDUCED IMPERVIOUSNESS EASEMENT
COMBINED WITH THE AVERAGE LOT SIZE BEING RECORDED ACHIEVES
AN EQUIVALENT AVERAGE LOT SIZE IN THE RECORDED SECTION OF
LEAST FIVE ACRES. ONCE AN INITIAL PERMIT OF THE UPPER SWIFT
CREEK WATERSHED PLAN HAS BEEN ISSUED THEN THIS CONDITION IS
NO LONGER APPLICABLE AND THE TEMPORARY REDUCED
IMPERVIOUSNESS EASEMENT SHALL BE AUTOMATICALLY VACATED AND
REMOVED AT THAT TIME.
12. THE NAME OF THE GEOTECHNICAL PROFESSIONAL WHO WILL
PROVIDE THE GEOTECHNICAL APPROVAL ON THE DAM WILL BE
FURNISHED ON THE LAND DISTURBANCE PERMIT.
NOTE: FROM PROFFERED CONDITION #17 OF REZONING CASE
02SN0209: THE DEVELOPER SHALL LEAVE IN PLACE THE TEMPORARY
SEDIMENT CONTROL DEVISES AND/OR CONSTRUCTED NEW BMPS OR
COMBINATIONS OF BMPS WHICH WOULD ACHIEVE A MAXIMUM
PHOSPHOROUS RUNOFF LIMIT REQUIRED BY THE UPPER SWIFT CREEK
WATERSHED ORDINANCE SECTION 19.1-541.4.A.1 UNTIL
CHESTERFIELD COUNTY OBTAINS ITS INITIAL PERMIT FOR THE
IMPLEMENTATION OF THE UPPER SWIFT CREEK WATERSHED PLAN. THE
CORPS OF ENGINEERS/DEQ ISSUANCE OF PERMITS FOR REGIONAL BMP
WBC10 IN THE FOXCREEK SUBDIVISION HAS SATISFIED THIS
PROFFER.
