1. How are clients placed on local probation supervision and referred to CCS?
Individuals are placed on local probation supervision and referred to CCS by Judges in the General District and Circuit Courts in Chesterfield and Colonial Heights as a sentencing option, and an alternative to incarceration.
2. What services are available through CCS?
Available services to the court are: community service, alcohol and drug testing, alcohol and drug screening and assessments, referrals for alcohol and drug education and treatment, anger management classes, shoplifting prevention classes, Moral Reconation Therapy classes, restitution collection and monitoring and probation supervision.
3. Who is eligible for referral to CCS?
Eligibility is in accordance with Virginia Code 19.2-303.3 and includes: Offenders 18 years old, or considered an adult at the time of conviction, of a misdemeanor or a non-violent felony for which the court may impose a jail sentence.
4. How long is an individual generally on probation supervision?
A client who has a return to court date established must be supervised until the return to court date, or three months if the client has completed all court ordered requirements, whichever comes first. For a client who does not have a return to court date established, the general guideline is three months minimum for misdemeanants and six months minimum for felons. A substance abuse tested client must remain on supervision until his return to court date or six months, whichever comes first.
5. Does an individual pay a fee for participation in the Local Probation Supervision Program?
Yes, all offenders under local probation supervision will be charged a one-time fee of $50.00. Additionally, if the client is court ordered at the time of sentencing to complete any of the following, he or she shall pay an additional one-time fee of $50.00 (for a total of $100.00)
- Drug/Alcohol Testing
- Shoplifter’s Prevention Group
- Anger Management Group
- Moral Reconation Therapy
- Batterer’s Intervention Program
- SSI/ASI (substance abuse evaluation)
- Other group services provided in-house by CCS
6. What are the responsibilities of the client while under Local Probation Supervision?
The main conditions are as follows:
- Keep the peace, be of good behavior, and not violate any municipal, county, state, or federal laws and ordinances.
- Follow CCS staff’s instructions and be truthful and cooperative.
- Not to illegally use, possess, or distribute narcotics, dangerous drugs, controlled substances, or drug paraphernalia.
- Meet with their Local Probation Officer as instructed.
- Comply with all court ordered requirements
7. What is the non-compliance or violation process?
If a client violates the conditions of his local probation supervision by testing positive for illegal substances, not reporting for a test, missing scheduled appointments, absconding from supervision, or violation of any other agreed upon condition, the assigned probation officer will notify the court. It will be at the discretion of the court as to the legal course of action taken against the client for his alleged violation.
